Apple in focus: New developments in the dispute with xAI

The conflict between xAI, Apple, and OpenAI is taking on new dimensions. A US court has granted Apple and OpenAI more time to respond to the lawsuit filed by Elon Musk's AI company, while xAI is simultaneously attempting to obtain information from South Korea through international legal assistance. The case touches upon key issues surrounding competition, App Store policies, and Apple's role in the AI market.

The dispute stems from the allegation that Apple, through its collaboration with OpenAI, influenced competition in the App Store. After Grok fell from the top of the App Store charts following an update, xAI saw this as a sign of unfair preferential treatment for OpenAI products. Apple rejected the accusation, but the legal proceedings are gaining momentum. New documents show that both the extension of the deadline for Apple and OpenAI and the international investigation for xAI have been officially confirmed.

Apple and OpenAI get more time

Several weeks ago, US District Judge Mark Pittman rejected Apple and OpenAI's request to dismiss xAI's lawsuit entirely. Pittman argued that more evidence was needed before a decision could be reached. The companies then filed a motion for an extension to prepare a more comprehensive response. The court granted this request. The new deadline for Apple and OpenAI is now December 11.

This procedure is standard in such cases, as large tech companies rarely submit their statements without thorough review. Pittman's decision compels both parties to provide detailed documentation clarifying whether Apple's partnership with OpenAI actually influences the visibility of other AI apps in the App Store.

xAI requests international legal assistance

In parallel with the extension of the deadline, xAI received the green light for an unusual step. The company submitted a request for the taking of evidence abroad. This request is based on the Hague Convention on the Taking of Evidence in Civil and Commercial Matters. The court approved the request and confirmed that the request for legal assistance, including a Korean translation, will be officially issued and forwarded directly to the National Court Administration of the Republic of Korea.

The ruling means that a previously unnamed South Korean organization will be involved in the proceedings. The documents do not specify which company is affected. Speculation ranges from Samsung and SK Hynix to Kakao. Samsung and SK Hynix are among OpenAI's key hardware and infrastructure partners. Kakao, in turn, collaborates with OpenAI to integrate ChatGPT into its super app KakaoTalk, which is used by over 90 percent of the South Korean population. However, it is also possible that the company involved is someone else that has not yet been publicly linked to the case.

Why Apple is the focus of criticism

xAI's core allegation remains. According to Musk, the partnership between Apple and OpenAI has resulted in other AI providers performing worse in the App Store. Specifically, the question is whether Grok was deliberately disadvantaged after its update. Apple vehemently denies this. The court nevertheless wants to clarify how closely OpenAI is integrated into Apple's products and whether this constitutes a market restriction.

Apple is in the spotlight because, as the operator of the App Store, the company wields enormous power over the visibility and success of digital products. Any decision that suggests Apple favors or disadvantages certain providers would have repercussions for the entire ecosystem. The proceedings could even influence future AI collaborations and Apple's strategy in this area.

xAI vs. Apple & OpenAI: Open questions before the next court round

Until December 11th, it remains unclear how Apple and OpenAI will respond to xAI's lawsuit. It is also unclear which South Korean institution has been involved in the legal assistance proceedings and what role the requested information will play. What is certain is that the case goes far beyond a dispute over App Store rankings. The developments touch upon fundamental questions surrounding competition, transparency, and the use of AI within the Apple ecosystem. The next steps in the proceedings could determine how open the market remains and what position Apple occupies in the global AI landscape.
