It concerns an order requiring Apple to grant the government access to encrypted cloud backups of British users.<\/p>\n\n\n\n<p>Technically, this boils down to a fundamental question. With enhanced data protection, the keys reside exclusively on users&#039; devices, not with Apple. Releasing them would only be possible if the company redesigned or deliberately weakened the service \u2013 access to existing data is impossible in the current architecture.<\/p>\n\n\n\n<p class=\"translation-block\">The way the case came to light is remarkable. Neither Apple nor the government announced it; it was revealed through a court order. The same pattern characterized the first round, in which <a href=\"https:\/\/www.apfelpatient.de\/en\/news\/apple-rejects-backdoor-court-overturns-secrecy\" data-wpel-link=\"internal\" target=\"_self\">a court overturned the confidentiality of the proceedings<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-anderthalb-jahre-streit-im-uberblick\">A year and a half of conflict: an overview<\/h2>\n\n\n\n<p>The conflict has changed direction several times. What initially appeared to be a concession turned out to be a narrowing of the scope a few weeks later: the <a href=\"https:\/\/www.apfelpatient.de\/en\/news\/uk-demands-access-to-icloud-data-again\" data-wpel-link=\"internal\" target=\"_self\">demand returned in a new form<\/a>, this time limited to British users. At the beginning of 2026, <a href=\"https:\/\/www.apfelpatient.de\/en\/news\/dispute-over-icloud-us-demands-clarification-from-uk\" data-wpel-link=\"internal\" target=\"_self\">US authorities demanded clarification from London on this matter<\/a>.<\/p>\n\n\n\n<p class=\"translation-block\">Apple received support not only from Washington. <a href=\"https:\/\/www.apfelpatient.de\/en\/news\/whatsapp-backs-apple-in-dispute-with-great-britain\" data-wpel-link=\"internal\" target=\"_self\">WhatsApp also sided with the company in the proceedings<\/a>, because a ruling against Apple would affect the very foundation of all end-to-end encryption.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-was-das-fur-nutzer-hierzulande-bedeutet\">What this means for users in this country<\/h2>\n\n\n\n<p class=\"translation-block\">The short answer: nothing immediately. Since October 2025, the regulation applies exclusively to British users. In Germany, Austria, and Switzerland, <a href=\"https:\/\/www.apfelpatient.de\/en\/tips-tricks\/enable-enhanced-data-protection-in-icloud\" data-wpel-link=\"internal\" target=\"_self\">Extended Privacy for iCloud<\/a> can still be activated unchanged \u2013 unlike in the UK, where Apple <a href=\"https:\/\/www.apfelpatient.de\/en\/news\/apple-stops-icloud-encryption-after-uk-order\" data-wpel-link=\"internal\" target=\"_self\">disabled the feature for new users in February 2025<\/a>.<\/p>\n\n\n\n<p>If you haven&#039;t enabled this feature yet, that&#039;s the practical point of this notification. Without it, iCloud backups, photos, and notes exist in a format that Apple can technically access\u2014and that&#039;s precisely what government orders usually aim for.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-warum-der-fall-uber-grossbritannien-hinausreicht\">Why the case extends beyond Great Britain<\/h2>\n\n\n\n<p>The real issue is not the scope of the order, but its feasibility. As soon as a court determines that a provider can be compelled to retroactively decrypt end-to-end encryption, a precedent exists \u2013 and this can be cited in any legal system attempting something similar.<\/p>\n\n\n\n<p class=\"translation-block\">That this is not an isolated case is demonstrated by the situation in North America: In May 2026, Apple warned against a <a href=\"https:\/\/www.apfelpatient.de\/en\/news\/apple-warns-of-backdoor-law-in-canada-bill-c-22\" data-wpel-link=\"internal\" target=\"_self\">proposed law in Canada<\/a> that aims in the same direction. For Apple, the British dispute is therefore less a market problem than a fundamental question about its own security promise.<\/p>\n\n\n\n<p>The timeframe remains unclear. Proceedings before the Investigatory Powers Tribunal are largely closed to the public, and the first round alone took over a year to produce any tangible progress.
