Nun hat der Chiphersteller im Patentstreit gegen Apple ein Verkaufsverbot von bestimmten iPhones in Deutschland erwirkt.\u00a0Grund daf\u00fcr sei die Verletzung eines Patents, dessen Technik den Stromverbrauch des Mobilfunkchips optimiert. Qualcomm zufolge k\u00f6nne Apple dies nicht mittels eines iOS-Updates \u00e4ndern.\u00a0Heute hat das Landgericht M\u00fcnchen ein Urteil zugunsten des Halbleiterherstellers ausgesprochen. Demnach darf Apple hierzulande die iPhone 7, iPhone 7+, iPhone 8, iPhone 8+ und iPhone X Modelle nicht mehr verkaufen bzw. in Verkehr bringen. Die aktuelle iPhone Generation ist davon nicht betroffen. Das Urteil ist noch nicht rechtskr\u00e4ftig, aber vorl\u00e4ufig vollstreckbar &#8211; Apple hat bereits angek\u00fcndigt in Berufung gehen zu wollen. Qualcomm darf bei einer Sicherheitszahlung von 668,4 Mio. Euro direkt gegen Apple vorgehen.<\/p>\n<p class=\"p1\"><\/p>\n<p>Eine solche Sicherheitsleistung wird vorausgesetzt, damit m\u00f6gliche Schadensersatzzahlungen an Apple gew\u00e4hrleistet sind. Diese k\u00f6nnen anfallen, wenn Qualcomm in einer h\u00f6heren Instanz den Prozess am Ende verlieren sollte.<\/p>\n<p><strong>Was ist eine Vorl\u00e4ufige Vollstreckbarkeit?<\/strong><\/p>\n<p>Vorl\u00e4ufige Vollstreckbarkeit bezeichnet die M\u00f6glichkeit, aus einem noch nicht rechtskr\u00e4ftigen Gerichtsurteil die Zwangsvollstreckung zu betreiben. Die Voraussetzungen, unter denen ein Urteil f\u00fcr vorl\u00e4ufig vollstreckbar erkl\u00e4rt werden kann, ergeben sich aus den \u00a7\u00a7 708 ff. der Zivilprozessordnung (ZPO).<\/p>\n<p><strong>Verkaufsverbot ab sofort wirksam<\/strong><\/p>\n<p class=\"p1\"><\/p>\n<p>Nun hat Qualcomm genau das getan. Der Halbleiterhersteller hat offiziell ein Verkaufsverbot ausgesprochen und geht dadurch selbst ein kostspieliges Risiko ein. Apple hat die betroffenen iPhone Modelle aus seinen 15 Ladengesch\u00e4ften in Deutschland entfernt und somit den Verkauf dieser vorl\u00e4ufig eingestellt. Einem Sprecher des iKonzerns zufolge sei Apple von dem Urteil entt\u00e4uscht und werde dagegen vorgehen.
